§ 1 DEFINITIONS
Working days – days from Monday to Friday, excluding public holidays in Poland.
Consumer – A Buyer who is a natural person, making a purchase in the Shop or taking steps to make a purchase, without any direct connection to their business or professional activities.
Account – a digital service governed by separate terms and conditions within the meaning of the Consumer Rights Act, which allows the Buyer to use additional features in the Shop free of charge.
Buyer – any person making a purchase in the Shop or taking steps to make a purchase.
Preferential buyer – a consumer or a preferential business.
A privileged trader – a Buyer who is a natural person and who enters into, or intends to enter into, a contract with the Seller under these Terms and Conditions that is directly related to their business activities but is not of a professional nature.
Terms and Conditions – these Terms and Conditions.
The Shop – the DB Nutrition online shop operated by the Seller at www.dbnutritions.com.

§ 2 CONTACTING THE SELLER

- The cost of telephone calls or data transmission made by the Buyer is based on the standard tariff of the telecommunications operator or internet service provider used by the Buyer. The Seller notes that the cost of an international call or international data transmission may be higher than the cost of a domestic call or transmission – depending on the tariff applied by the telecommunications operator or internet service provider used by the Buyer.
§ 3 TECHNICAL REQUIREMENTS
- For the Shop to function properly, the following is required:
- a device with internet access,
- a web browser that supports JavaScript and cookies.
- To place an order in the Shop, in addition to the requirements set out in paragraph 1, you must have an active email account.
§ 4 SHOPPING IN THE STORE
- The prices of products shown in the Shop are the total prices per item.
- The Seller notes that the total price of the order comprises the items specified in the Shop: the price of the product and, where applicable, the delivery costs.
- Please add the product you wish to purchase to your basket in the Shop.
- The Buyer then selects the delivery method and payment method for the order from the options available in the Shop, and provides the details required to fulfil the order.
- An order is placed once the Buyer has confirmed its details and accepted the Terms and Conditions.
- Placing an order constitutes the conclusion of a contract between the Buyer and the Seller.
- The buyer may register with the Shop, i.e. create an account, or make purchases without registering by providing their details each time they place an order.
§ 5 PAYMENTS
- The following payment methods are available in the Shop:
- via the Przelewy24 payment platform
- If the Buyer chooses to pay in advance, the order must be paid for within 1 working day of placing the order.
- By making purchases in the Shop, the Buyer agrees to the Seller’s use of electronic invoices. The Buyer has the right to withdraw this consent.
§ 6 ORDER PROCESSING
- The delivery time is stated in the Shop.
- If the Buyer has chosen to pay for the order in advance, the Seller will proceed to fulfil the order once payment has been received.
- If, within a single order, the Buyer has purchased products with different delivery times, the order will be fulfilled by the date applicable to the product with the longest delivery time.
- Countries to which deliveries are made: Poland, Germany, France, Sweden, the Netherlands, Spain, the United Kingdom, Austria.
- The following delivery methods are available in the Shop:
- via a courier service to the address specified by the Buyer;
- to InPost parcel lockers.
§ 7 RIGHT TO WITHDRAW FROM THE CONTRACT
- A priority buyer has the right to withdraw from a contract concluded with the Seller via the Shop, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.
- The deadline for withdrawing from the contract expires 14 days after the date:
- in which the preferred buyer took possession of the goods, or in which a third party other than the carrier and designated by the preferred buyer took possession of those goods;
- where the preferred buyer took possession of the last item, consignment or part thereof, or where a third party, other than the carrier and designated by the preferred buyer, took possession of the last item, consignment or part thereof, in the case of a contract requiring the transfer of ownership of multiple items of goods which are delivered separately, in consignments or in parts.
- In order for the Preferred Buyer to exercise their right to withdraw from the contract, they must inform the Seller, using the contact details provided in § 2 of the Terms and Conditions, of their decision to withdraw from the contract by means of an unambiguous statement (for example, a letter sent by post or email).
- A priority buyer may use the model withdrawal form provided at the end of the Terms and Conditions, although this is not mandatory.
- To meet the deadline for withdrawing from the contract, the priority buyer need only send notification of their intention to exercise their right to withdraw from the contract before the withdrawal period expires.
CONSEQUENCES OF WITHDRAWAL FROM THE CONTRACT
- In the event of withdrawal from the contract, the Seller shall refund to the Preferred Buyer all payments received from the Preferred Buyer, including the costs of delivery (with the exception of any additional costs arising from the Preferred Buyer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller), without undue delay, and in any event no later than 14 days from the date on which the Seller was informed of the Preferred Buyer’s decision to exercise their right to withdraw from the contract.
- The Seller shall issue the refund using the same payment methods that the Preferred Buyer used in the original transaction, unless the Preferred Buyer agrees to an alternative arrangement; in any event, the Preferred Buyer shall not incur any charges in connection with this refund.
- If the Seller has not offered to collect the goods from the eligible Buyer themselves, they may withhold the refund until they have received the goods or until they have been provided with proof that the goods have been returned, whichever occurs first.
- The Seller requests that the goods be returned to the following address: 5/7 Joachima Chreptowicza Street, 16-300 Augustów, without delay and in any event no later than 14 days from the date on which the Buyer with the right of withdrawal notified the Seller of their withdrawal from the contract of sale. The deadline is met if the Buyer sends the goods back before the expiry of the 14-day period.
- The buyer bears the direct costs of returning the goods.
- A buyer with a special right of withdrawal is liable only for any reduction in the value of the goods resulting from their use in a manner other than that necessary to establish the nature, characteristics and functioning of the goods.
- If, due to their nature, the goods cannot be returned by standard post, the Preferred Buyer will also be required to bear the direct costs of returning the goods. The Preferred Buyer will be informed of the estimated cost of these charges by the Seller in the product description on the Shop or when placing the order.
§ 8 EXCEPTIONS TO THE RIGHT TO WITHDRAW FROM THE CONTRACT
- The right to withdraw from a distance contract, as referred to in § 7 of the Terms and Conditions, does not apply to a contract:
- where the subject of the supply is non-prefabricated goods, manufactured to the specifications of the preferred buyer or designed to meet their specific needs;
- where the subject of the supply is perishable goods or goods with a short shelf life;
- where the subject of the supply is goods delivered in sealed packaging which, once opened, cannot be returned for health or hygiene reasons, provided that the packaging was opened after delivery;
- where the subject of the supply is goods which, upon delivery, are, by their nature, inseparably combined with other items;
- where the subject of the supply is audio or video recordings or computer software supplied in sealed packaging, if the packaging has been opened after delivery;
- for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts;
- where the price or remuneration depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the expiry of the withdrawal period.
§ 9 COMPLAINTS
I GENERAL PROVISIONS
- The Seller bears primary liability towards the Buyer for the conformity of the goods with the contract, as provided for by generally applicable law, including in particular the provisions of the Consumer Rights Act.
- The Seller requests that complaints (including those concerning the operation of the Shop) be submitted to the postal or email address specified in § 2 of the Terms and Conditions.
- If a warranty has been provided for the product, details of the warranty and its terms and conditions are available in the Shop.
- The seller will respond to the complaint within 14 days of receiving it.
II PREFERRED BUYERS
A. Goods
- Where the goods do not comply with the contract, the buyer is entitled to exercise the rights set out in Chapter 5a of the Consumer Rights Act.
- The Seller shall be liable for any lack of conformity of the goods with the contract that existed at the time of delivery and which becomes apparent within two years of that time, unless the shelf life of the goods, as specified by the Seller, its legal predecessors or persons acting on their behalf, is longer.
- Under the provisions of the Consumer Rights Act, in the event of a breach of contract, the buyer may demand:
- exchange of goods,
- repairs to the goods.
- In addition, a preferred buyer may submit a declaration regarding:
- a price reduction,
- withdrawal from the contract
in a situation where:
- The seller refused to bring the goods into conformity with the contract in accordance with section 43d(2) of the Consumer Rights Act;
- The seller has failed to bring the goods into conformity with the contract in accordance with Article 43d(4)–(6) of the Consumer Rights Act;
- the goods still do not comply with the contract, despite the Seller’s attempts to bring them into conformity with the contract;
- the lack of conformity of the goods with the contract is of such significance that it justifies a price reduction or withdrawal from the contract without first resorting to the remedies set out in Article 43d of the Consumer Rights Act;
- it is clear from the Seller’s statement or the circumstances that the Seller will not bring the goods into conformity with the contract within a reasonable time or without undue inconvenience to the priority Buyer.
- In the event that goods are to be repaired or replaced, the Preferred Buyer must make those goods available to the Seller. The Seller shall collect the goods from the Preferred Buyer at its own expense.
- A buyer with preferential rights may not withdraw from the contract if the lack of conformity of the goods with the contract is minor.
- In the event of withdrawal from the contract referred to in this section (concerning goods), the Preferred Buyer shall immediately return the goods to the Seller at the Seller’s expense, to the address: ul. Joachima Chreptowicza 5/7, 16-300 Augustów. The Seller shall refund the price to the Buyer without undue delay, no later than within 14 days of receiving the goods or proof of their return.
- The Seller shall refund to the Preferential Buyer any amounts due as a result of the exercise of the right to a price reduction without delay, and no later than 14 days from the date of receipt of the Preferential Buyer’s notice of price reduction.
B. Out-of-court methods of handling complaints and pursuing claims
- The Seller informs the Consumer of the possibility of using out-of-court complaint handling and redress procedures. The rules governing access to these procedures are available at the offices or on the websites of the bodies authorised to handle disputes out of court. The Consumer may, amongst other things, seek assistance from the relevant European Consumer Centre (list: https://konsument.gov.pl/eck-w-europie/). Furthermore, within the territory of the Republic of Poland, you may make use of: mediation conducted by the competent Provincial Inspectorate of Trade Inspection and the assistance of the competent permanent consumer arbitration court (list: https://uokik.gov.pl/kontakt-inspekcja-handlowa). As a rule, these proceedings are free of charge.
- The above provision is for information purposes only and does not constitute an obligation on the part of the Seller to use alternative dispute resolution.
- The use of out-of-court complaint and redress procedures is voluntary for both the Seller and the Consumer.
- Consumers may also seek free assistance from the municipal or district consumer ombudsman.
III. BUYERS OTHER THAN PREFERRED BUYERS
- For the avoidance of doubt, the Seller notes that the provision of § 11(7) applies to the Seller’s liability towards a Buyer other than a priority Buyer in connection with a complaint.
§ 10 PERSONAL DATA
- The Seller is the controller of the personal data provided by the Buyer when using the Shop. Detailed information regarding the processing of personal data by the Seller – including other purposes and legal bases for data processing, as well as the recipients of the data – can be found in the privacy policy available on the Shop.
- The purpose of the Seller’s processing of the Buyer’s data, provided by the Buyer in connection with purchases made in the Shop, is to fulfil orders. The legal basis for the processing of personal data in this case is:
- a contract or actions taken at the Buyer’s request with a view to entering into such a contract (Article 6(1)(b) of the GDPR),
- the legal obligation incumbent on the Seller, relating in particular to accounting and product safety (Article 6(1)(c) of the GDPR) and
- the Seller’s legitimate interest in processing data for the purpose of establishing, exercising or defending potential claims (Article 6(1)(f) of the GDPR).
- the Buyer’s explicit consent (Article 9(2)(a) of the GDPR) – in relation to health information provided by the Buyer.
- The provision of personal data by the Buyer is voluntary, but is also necessary for the conclusion of the contract. Failure to provide such data will prevent the conclusion of a contract in the Shop.
- The Buyer’s personal data provided in connection with purchases made in the Shop will be processed until:
- the contract between the Buyer and the Seller will cease to have effect;
- the Seller will no longer be under a legal obligation to process the Buyer’s data;
- the Buyer or Seller will no longer be able to pursue claims relating to the contract concluded by the Shop;
- the Buyer’s objection to the processing of their personal data is upheld – where the basis for the processing was the Seller’s legitimate interest;
- the Buyer withdraws their consent to the processing of their personal data – where the basis for the processing was consent
– depending on which applies in the particular case.
- The buyer is entitled to request:
- access to your personal data,
- their corrections,
- deletion,
- restrictions on processing,
- transfer of data to another controller
as well as the right:
- to object at any time to the processing of data on grounds relating to the Buyer’s particular situation – in respect of the processing of personal data concerning them, based on Article 6(1)(f) of the GDPR (i.e. on the legitimate interests pursued by the Seller).
- In order to exercise their rights, the Buyer should contact the Seller using the contact details set out in § 2 of the Terms and Conditions.
- The buyer may withdraw their consent to the processing of health data at any time, without this affecting the lawfulness of any processing carried out prior to the withdrawal of consent.
- If the Buyer considers that their data is being processed unlawfully, they may lodge a complaint with the competent data protection authority. In Poland, this is the President of the Personal Data Protection Office.
§ 11 DISCLAIMERS
- The Buyer is prohibited from supplying unlawful content. Each order placed in the Shop constitutes a separate contract and requires separate acceptance of the Terms and Conditions. The contract is concluded for the duration and purpose of fulfilling the order.
- All contracts concluded under these Terms and Conditions shall be governed by Polish law, subject to paragraph 4.
- The choice of Polish law for contracts concluded with the Consumer under these Terms and Conditions does not override or limit the rights of that Consumer under mandatory provisions of law applicable to the Consumer in situations where no choice of law applies. This means, in particular, that if the national provisions applicable to a given Consumer provide for greater protection than that resulting from these Terms and Conditions or Polish law, that greater protection shall apply.
- Contracts concluded under these Terms and Conditions shall be drawn up in Polish.
- In the event of any dispute with a Buyer who is not a priority Buyer, arising from a contract concluded via the Shop, the competent court shall be the court with jurisdiction over the Seller’s registered office.
- Any liability on the part of the Seller towards a Buyer who is not a preferred Buyer, arising from a contract concluded via the Shop, is excluded to the extent permitted by law.
- The Website Terms and Conditions, available on the Shop’s website, apply to the use of the Shop’s website and the features available on it.
